These terms govern your use of Evoglyph, the local-first macOS dictation app. They describe the license you receive when you buy or trial Evoglyph, how billing works through our payment processor, and the limited promises and disclaimers attached to the software. They are written to be readable; if anything is unclear, email us at the address in the Contact section below.

Acceptance

By downloading, installing, activating, or using Evoglyph, you agree to these Terms of Service. You also accept these terms when you purchase Evoglyph and when you activate a license key. If you do not agree, do not install or use Evoglyph. If you are using Evoglyph on behalf of an organization, you represent that you have authority to bind that organization to these terms, and "you" refers to that organization.

Service description

Evoglyph is a macOS dictation application that captures microphone audio when you hold a hotkey, transcribes the audio to text on-device, and inserts the text into your focused application. Speech-to-text and optional AI cleanup run locally on your Mac. The app does not transmit your audio, transcripts, or vocabulary to any server. Evoglyph is gated by a license key issued at purchase; certain features require an active license to function.

Your free trial lasts until you’ve transcribed 3,000 words or 7 days pass, whichever comes first; after that Evoglyph copies dictation to your clipboard until you activate a license. For the full trial mechanics, device limits, and activation steps, see Licensing and activation.

License grant

Subject to your continued compliance with these terms and payment of any applicable fees, we grant you a non-exclusive, non-transferable, revocable license to install and use Evoglyph for personal or commercial purposes. Each license entitles you to activate Evoglyph on up to two devices unless your specific plan specifies a different number, in which case the count is shown at checkout and in the app's License settings. You may not reverse engineer, decompile, disassemble, redistribute, sublicense, sell, rent, lease, or otherwise transfer Evoglyph or your license key, except to the extent that this restriction is prohibited by applicable law. License keys are personal to the original purchaser; sharing a key with others is a material breach of these terms.

Subscriptions, billing, refunds

Evoglyph is sold by Eluketronic LLC, the seller of record for all purchases. Payments are processed by Stripe, which handles card processing and fraud prevention on our behalf; your card details are held by Stripe and are never stored by us. Prices are shown in US dollars and may be subject to sales tax, VAT, or similar taxes depending on where you are. Where we are required to collect such tax, it will be calculated and shown before you pay. Your software-license relationship is with us under these terms.

Evoglyph offers monthly and annual subscription plans and a one-time lifetime purchase. Subscriptions renew automatically at the interval shown at checkout (for example, monthly or annually) until you cancel. You can cancel anytime by emailing [email protected] (or, where available, through the billing portal linked on your account page); cancellation stops future renewals and your access continues until the end of the current paid period. Where the law requires advance notice before a renewal (for example, annual plans for some US states), we (or our payment processor) will provide it. If a renewal payment fails, your access continues during a 7-day grace period before the license lapses. We do not offer an automatic money-back guarantee; if you believe a charge was made in error, contact us and we will work with you in good faith. Where we approve a refund, the corresponding license is revoked; cancelling a subscription leaves you with access until the period ends, while a refunded lifetime purchase returns Evoglyph to its unlicensed state, in which it keeps running but copies each dictation to your clipboard instead of inserting text directly. Early-access cohort pricing

Evoglyph's early-access cohort is offered promotional pricing redeemed through a promo code at checkout. The discount that applies is the one shown at checkout when you redeem the code, and it stays with your license: subscriptions renew at the discounted rate for as long as you keep the subscription continuously active, and a lifetime cohort purchase is a one-time discounted payment. If you let a subscription lapse and resubscribe after the cohort window has closed, the new subscription is billed at standard pricing. After the cohort closes, new customers are billed at the standard price.

User conduct

You agree to use Evoglyph only for lawful purposes and only in ways that do not infringe the rights of others or restrict or inhibit anyone else's use of the software. Specifically, you will not: abuse the license-activation endpoint (including by automating activation requests, attempting to bypass device limits, or probing for vulnerabilities); share your license key publicly or with parties not covered by your license; use Evoglyph to dictate content you do not have a right to record (for example, recording other people without consent where consent is required); or use Evoglyph in connection with any activity that violates applicable law.

You are responsible for using Evoglyph lawfully, including getting any consent the law requires before recording or transcribing other people, and for the content you create with it.

Privacy

Evoglyph is local-first. The app does not collect your dictated audio, your transcripts, or your custom vocabulary; these never leave your Mac. The only data that crosses the network is your license key during activation and re-validation, and an anonymized device identifier for device-slot accounting. Disclaimer and limitation of liability

Evoglyph is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Evoglyph will be uninterrupted, error-free, or free of harmful components, nor do we warrant that transcription accuracy will meet your specific requirements. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of Eluketronic LLC arising out of or relating to Evoglyph, the EULA, or these Terms will not exceed the total amount you paid us for Evoglyph.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations above may not apply to you. Nothing in these terms limits or excludes liability that cannot be limited or excluded under the law that applies to you, including, where applicable, liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Termination

You may stop using Evoglyph at any time by uninstalling the app and cancelling your subscription by emailing [email protected] (or, where available, through the billing portal linked on your account page). We may suspend or revoke your license for material breach of these terms (for example, sharing license keys, abusing the activation endpoint, or attempting to reverse engineer the software), with or without prior notice depending on the severity of the breach. If we revoke your license for material breach, you are not entitled to a refund of fees already paid. If we cease to offer Evoglyph generally, we will give existing license holders reasonable notice and refund the unused portion of any prepaid term on a pro-rata basis.

Dispute resolution

Before filing a formal claim, contact us at [email protected] and give us 30 days to try to resolve it.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and you and Eluketronic LLC submit to the exclusive jurisdiction of the state and federal courts located in New York for any dispute, subject to any mandatory rights you have under the law of the country where you live.

Either of us may still bring an individual claim in a small-claims court that has jurisdiction.

Nothing here removes mandatory consumer-protection rights or the right to bring proceedings in your home country where the law of your country of residence guarantees that, for example for consumers in the EU, UK, or Australia.

Changes to these terms

We may update these terms from time to time. Non-material changes (typo fixes, clarifications that do not alter your rights) take effect immediately on publication. Material changes (such as changes to fees, license scope, refund policy, or liability) will be announced via in-app notification or email to the address on your license, and will take effect no sooner than 30 days after that notice. Your continued use of Evoglyph after the effective date of a material change means you accept the updated terms.

If you don’t agree to a change, you can stop using Evoglyph; if you have an active paid subscription you may cancel it for a refund of the unused period; if you bought a lifetime license you may continue under the terms that applied when you purchased.

General

Entire agreement. The Terms of Service, the End User License Agreement, the Privacy Policy, and the Refund Policy together form the entire agreement between you and Eluketronic LLC regarding Evoglyph, and they supersede any prior understanding or representation. Read them together. If a direct conflict arises, the EULA governs questions about your license to use the software, and these Terms govern the commercial relationship (purchase, billing, and refunds).

Severability. If any provision of these terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

Assignment. We may assign these terms, for example in connection with a sale of the business or its assets; you may not assign your account or these terms without our consent.

Force majeure. We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, such as outages of third-party services we rely on, acts of God, or other circumstances we could not reasonably prevent.

Indemnity. You agree to cover third-party claims that arise from your unlawful use of Evoglyph or content you create with it.

Waiver. Our failure to enforce any provision of these terms is not a waiver of our right to enforce it later.
